Reporting Lawyer Trust Accounts

For unclaimed client funds with a last known address in Oregon, held in Lawyer Trust Accounts (LTAs) or inactive Interest on Lawyer Trust Accounts (IOLTAs) at financial institutions, must be remitted to the Oregon State Bar. Until claimed from the Oregon State Bar, the remitted funds are used for the Legal Services program, which funds legal aid organizations that provide civil legal services to those who qualify statewide.

Affected holders need to send the report to the Oregon State Bar with your payment by the due date. As Oregon State Treasury and Oregon State Bar continue to work together to streamline this process, continue to use the Lawyer Trust Account form.

For attorneys and legal services firms, the abandonment period for lawyer trust accounts is three years.

For financial institutions, the abandonment period for IOLTA deposit accounts is three years. Report IOLTA bank accounts as a co-owned property. First owner is the Attorney/Firm specifics and IOLTA Unknown as the co-owner.

The property code for lawyer trust accounts and IOLTAs is TR88 Lawyer Trust Accounts-OSB. This code should be used only when funds are remitted to the Oregon State Bar.

Reminder: Oregon State Bar cannot accept funds from other states. If you have a last known address that is for another state, you must report and send to that state's unclaimed property program. Reference https://unclaimed.org/ to locate and directly link to the state's property you are holding.

If you have other property to remit to Oregon’s Unclaimed Property Program, this needs to be on a separate report. Do not comingle LTA/IOLTA properties and your other property types on a single report.
